PRIVACY POLICY

1 This document (hereinafter referred to as Privacy Policy) sets out the rules for the storage, collection, processing and protection of personal data of clients and contractors of SCALA Sp. z o.o. Spółka komandytowa ul. Syrokomli 1A, 35-210 Rzeszów (hereinafter referred to as SCALA) and the rules of using the so-called cookies used, among others, on the website https://scala.rzeszow.pl/.

(2) Personal data of customers and contractors of SCALA are protected to the extent and in the manner specified in the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119, p.1), hereinafter referred to as RODO in the Privacy Policy.

(3) The Administrator shall exercise due diligence in selecting and applying appropriate technical and organizational measures to ensure the protection of the processed data. We protect your data from being made available to unauthorized persons, as well as from being processed in violation of applicable laws.

4 In fulfillment of the information obligation set forth in Article 13 RODO, we inform you about the principles of processing your data:

  • Purposes of processing and legal basis for processing

We will process your personal data, in order to:

  • performance of the agreements concluded with SCALA;
  • running a comment system,
  • conducting online chat conversations,
  • handling inquiries through the form,
  • You may also consent to the processing of your personal data for the purpose of electronic transmission of marketing offers and commercial information in the form of a newsletter, which will be sent to the e-mail address you indicate.

The legal basis for processing your personal data is:

  • The necessity of your data for the performance of the contract concluded with us,
  • Your consent to the processing of data for receiving newsletters (commercial and marketing information).
  • Our legitimate interest. We have a legitimate interest in, for example, preventing fraud, defending against claims, and ensuring network and information security.

On this basis, we cannot process your data if your rights and freedoms will override our legitimate interest.

  • Categories of your data that we process

We will process your following data:

– Name, business name,

– The address of the registered office or other addresses used in business,

– e-mail address and telephone number,

– tax identification number (NIP) and REGON number,

– The name and contact information of your employees and associates.

  • Period of storage of personal data

We will keep your personal data until the statute of limitations for potential claims under the contract, including warranty claims.

We will keep your personal data that we process based on your consent to receive the newsletter until you object to its processing for this purpose or revoke your consent.

  • Recipients of data

We will transfer your personal data:

  • courier companies in order to carry out the delivery of the goods ordered by you,
  • to another entity if it becomes necessary to complete your order (e.g., payment system operators),
  • accounting firm for accounting purposes and settlement of concluded contracts,
  • law firm if necessary to defend our claims,
  • To companies providing hosting services to us,
  • payment operators,
  • operators of the comment system,
  • operators of online chat solutions,
  • authorized employees and associates who use the data to perform the contract,
  • to companies that provide marketing services.

Such entities process data on the basis of a contract with us and only in accordance with our instructions.

  • Transfer of data to third countries or international organizations

Your personal data will not be transferred to third countries or international organizations

  • Your rights related to the processing of personal data

You have the following rights related to the processing of personal data:

  1. The right to withdraw consent to data processing.
  2. The right to access your personal data and to receive a copy of it,
  3. The right to request rectification (amendment) of your personal data,
  4. The right to request the deletion of your personal data,
  5. The right to request restrictions on the processing of your personal data.
  6. The right to object to the processing of your data on the grounds of your particular situation – in cases where we process your data on the basis of our legitimate interest,
  7. The right to portability of your personal data, i.e. the right to receive your personal data from us, in a structured, commonly used machine-readable computer format. You can send this data to another data controller or request that we send your data to another controller. However, we will only do so if such a transfer is technically possible. You have the right to data portability only with respect to those data that we process on the basis of a contract with you or on the basis of your consent.

Right to withdraw consent

To the extent that your data is processed on the basis of consent (i.e. data provided in consent to receive newsletters from us) – you have the right to withdraw your consent to data processing at any time. The withdrawal of consent does not affect the lawfulness of the processing we have carried out on the basis of your consent before its withdrawal. You can withdraw your consent by sending a statement withdrawing your consent to our mailing address or to our email address indicated in Section 1.

The right to lodge a complaint with the authority

You also have the right to lodge a complaint with the supervisory authority in charge of personal data protection, i.e. the President of the Office for Personal Data Protection or other competent supervisory authority.

  • Information about the requirement/voluntariness of providing data

Your provision of data is a condition for entering into a contract. It is voluntary, but necessary for the conclusion and execution of the contract.

If you do not provide us with your data we may refuse to enter into a contract.

Your submission of data and consent to the processing of personal data for marketing purposes is voluntary.

  • Information about automated decision-making

We do not use automated decision-making tools.

(5) SCALA collects automatically only information contained in cookies, by which is meant small text information in the form of text files, sent by the server of a given online store and stored on the side of the user visiting the store’s website (e.g. on the hard drive of a computer, laptop, or smartphone memory card – depending on what device a given user uses).

6. in connection with providing access to the content of https://scala.rzeszow.pl/ website uses the so-called “cookies”, i.e. information recorded by the servers on the user’s terminal equipment, which the servers can read at each connection from that terminal equipment, may also use other technologies with functions similar or identical to cookies. In this document, the information on cookies also applies to other similar technologies used as part of our websites. Cookies (so-called “cookies”) are IT data, in particular text files, which are stored on the end device of the https://scala.rzeszow.pl/ website user. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the settings of the web browser or inform about their placement on the web site user’s device each time. Detailed information on the possibility and methods of handling cookies is available in the settings of your software (web browser). Failure to change the settings for cookies means that they will be placed on the user’s terminal device, and thus we will store information on the user’s terminal device and access this information.

10. disabling the use of cookies may make it difficult to use some services on our websites, in particular those requiring a login. However, disabling the option of accepting cookies does not prevent you from reading or viewing content on https://scala.rzeszow.pl/.
